Adult Guardianship and Family Trust
Both the Adult Guardianship system and a Family Trust can be said to be means to relieve anxiety about your retirement.
However, they need to be used differently depending on the purpose.
First, the "Adult Guardianship system" is a system in which, while you still have sufficient capacity, you enter into a contract with an agent (adult guardian) to whom you entrust your daily life, nursing care, and asset management, etc., in preparation for the future when you no longer have sufficient capacity to make decisions.
In this case, you are free to choose your own agent.
Next, a "Family Trust" is a contract in which you request a family member to manage, dispose of, etc. your assets (real estate, securities, etc.).
Although both systems seem similar, the biggest difference between them is whether or not they include "personal care".
With Adult Guardianship, you can entrust personal care to someone else, but with a Family Trust, you cannot entrust personal care to someone else.
Therefore, you will need to choose whether to use the Adult Guardianship system or a Family Trust, depending on what you want to entrust to someone else.
It is also possible to use both systems together.
