By When Must a Company’s Capital Be Increased to 30 Million Yen or More for the "Business Manager" Status of Residence?
Due to a revision of the requirements for the "Business Manager" status of residence, the criterion for the total amount of property has been amended to: "The total amount of property allocated for the business pertaining to the application (including the amount of capital and the total amount of investment) must be 30 million yen or more."
For corporations (such as joint-stock companies [Kabushiki Kaisha] and limited liability companies [Godo Kaisha]), the total amount of property corresponds to the amount of capital or the total amount of investment.
This new requirement will apply to applications for the Extension of Period of Stay for the "Business Manager" status of residence submitted on or after October 16, 2028.
However, according to the Q&A published by the Immigration Services Agency, it states:
"Even if an applicant does not meet the revised permission criteria at the time of applying for an Extension of Period of Stay after three years have elapsed from the enforcement date, if the business's financial health is sound, tax obligations (such as corporate taxes) are properly fulfilled, and there is a prospect of meeting the revised criteria by the next renewal, a comprehensive decision will be made by considering other residence-related circumstances. Therefore, an application will not be uniformly disapproved solely on the grounds that 'the total amount of property allocated for the business pertaining to the application' (the amount of capital for corporations, or the total amount invested as necessary to run the business for sole proprietors) is less than 30 million yen."
According to this guideline, even if your capital is less than 30 million yen at the time of applying for an Extension of Period of Stay on or after October 16, 2028, there is a possibility that the extension may be granted. However, since the final decision will be made based on a comprehensive assessment of various other conditions, we strongly recommend increasing your capital to 30 million yen or more by that time.
