When a Japanese National Residing Overseas Prepares an Estate Partition Agreement

When an inheritance begins, an "Estate Partition Agreement" (Isan Bunkatsu Kyogisho) must be prepared if the estate is to be divided in proportions different from the statutory inheritance shares, or if the title of real estate or other assets needs to be transferred.
An Estate Partition Agreement requires the names and registered seals (jitsuin) of all heirs.
However, if you reside overseas and do not have a registered address in Japan, you cannot register a jitsuin, making it impossible to affix a registered seal.
In such cases, you can sign the agreement instead of using a name and registered seal by obtaining a "Signature Certificate" (Sain Shomeisho) and attaching it to the document.
